Conservation Area Rules and Regulations
Pursuant to Massachusetts General Laws, Chapter 40, Section 8c, as amended, the following rules and regulations governing the use of all of the Town of Brookline Conservation Areas (hereinafter "the Areas") under the management of the Conservation Commission of the Town of Brookline have been adopted to insure appropriate use of the Areas for the enjoyment and general welfare of the public while protecting the areas in their natural states to serve as wildlife refuges.
Use of the Areas:
- The Areas shall be open from dawn to dusk.
- Use of any of the Areas shall be limited to passive recreational pursuits such as walking, reading, sitting, bird watching, observing wildlife.
- Any use not specified by above shall require review by the permit from the Conservation Commission which may set a fee according to the type of use, duration, and number of individuals involved.
- There shall be no hunting in any of the Areas.
- Use of the trails in any of the Areas is limited to pedestrians.
- No person shall enter or leave any of the Areas except at the regularly designated entrance and exit.
Conduct in the Areas:
- There shall be no dumping or littering of brush, leaves, grass clippings, debris, beverage or other containers in any of the areas. A refuse receptacle is provided at the main entrance. We encourage cooperation by all visitors in keeping the Areas clean. Dumping violations shall be punished in accordance with the provisions of general laws, Chapter 270, Section 161 as may be amended from time to time.
- No person shall mutilate, remove, apply paint to or otherwise deface property in any of the Areas. The said property shall include any tree, bush, plant, fern, flower, rock, sign, fence, boardwalk or any other object located within any of the Areas.
- No person shall deposit any article or item in any of the Areas, including any living, dead or man-made item.
- No person shall have possession of or discharge any firecracker or fireworks, handgun, rifle, air gun, or other firearm, bow and arrow, sling shot or throw a stone or missile, or set any trap or snare in any of the Areas.
- There shall be no fires or smoking in any of the Areas. Violations of fire regulations shall be reported directly to the Fire Department at 232-8366. For emergencies, call 911.
- No person shall annoy another, or act in any manner offensive to others, beg or canvass for alms or donations, utter any profane threatening or abusive or indecent language or disturb the peace, or act in an obscene or indecent manner; drink or be under the influence of or have possession of any intoxicating beverage; or have any instrument of gambling or play any game of chance in any of the Areas.
- No sign, symbol, banner, notice, placard or advertising device shall be posted, affixed, displayed, carried or worn within any of the Areas.
- No person shall climb upon or over any fence, balustrade, monument, fountain, tree, or any other object not intended for such purpose.
Vehicles:
- No person shall drive or ride any bicycle or motor vehicle including but not limited to, automobiles, snowmobiles, trail bikes, in or through any of the Areas.
- There shall be no parking in any of the Areas.
- Vehicles found violating any provisions of 15 and 16 above may be moved by or under the direction of a Police Officer of the Town of Brookline or the Park Police or member of the Conservation Commission, or its authorized representatives, and at the expense of the owner, to a place where parking is allowed or to any area designated by the Town for storage.
Animals:
- No person shall injure or disturb or have possession of any wild animal or bird, injure or disturb any bird, bird nest, eggs, or wildfowl in any of the areas.
- No one shall bring any animals or pets to any of the Areas.
- No horses or ponies are permitted on the trails of any of the Areas.
Other Prohibited Activities:
- No picnicking shall be allowed in any of the Areas.
- No camping or pitching of a tent shall be allowed in any of the Areas.
- No fishing shall be allowed in any of the Areas.
- No ice-skating or other use of the ice shall be allowed in any of the Areas.
- No swimming, wading, or boating shall be allowed in any of the Areas.
- Archery, golf, model airplane flying and frisbie or ball playing are prohibited in all of the Areas.
- No person shall sell or offer for sale any merchandise of any description and without limiting the generality of the foregoing, any food or soft drinks in any of the areas. Nor shall any person solicit business from a street or way adjacent to any such public area.
- No land or water alteration or spraying shall be done in the Area by the Norfolk County Mosquito Control Project, or by any like agency with the permission by vote of the Conservation Commission.
Enforcement of Rules and Regulations:
- No breach of the above rules shall be allowed without prior written permission of the Conservation Commission.
- No person in any such public area shall fail to comply with any reasonable direction given by any police officer or by any authorized person of the Park Department or conservation Commission or contained in any notice posted by the conservation Commission. The lands or structures under the control of the conservation Commission are public property and it is the duty of every person to see that the above rules are observed and to call to the attention of the Police or person in charge of any violation thereof.
- The Brookline Police Department is hereby authorized to enforce all of the above rules and regulations:
Violations of any of the aforesaid rules and regulations is punishable under the provisions of General Laws Chapter 45, Section 24, as amended, which reads as follows:
"Whoever violates any rule or regulation for the government or use of any land taken or held under this chapter or for like purposes of any special act, and made under authority of law by any board or officer in charge thereof, shall be punished by a fine of not more than two hundred dollars."
